General Information

The protection of your personal data is of particular importance to Cherry Patterns e.U. (hereinafter referred to as the “Agency”). The Agency processes your data exclusively on the basis of the applicable legal provisions (GDPR, TKG 2021). Use of the Agency’s website is generally possible without providing personal data. Where personal data is collected, this is done on a voluntary basis wherever possible.

Cookies

The Agency’s website uses cookies to provide essential functionality and to analyse usage. Cookies that are not strictly necessary are only set with your consent. Upon your first visit, you can select your cookie preferences via a cookie banner. You may change or withdraw your consent at any time.

Website Analytics

For the analysis and improvement of its website, the Agency uses Google Analytics, a web analytics service provided by Google LLC. Google Analytics uses cookies that enable an analysis of your use of the website. This may include processing of data such as your truncated or anonymised IP address, device and browser information, and usage behaviour. Processing is carried out exclusively on the basis of your consent in accordance with Article 6 (1) (a) GDPR. Google Analytics will not be activated without your consent. In the course of using Google Analytics, data may be transferred to the United States and other third countries. For such transfers, Google uses standard contractual clauses pursuant to Article 46 GDPR. Nevertheless, it cannot be ruled out that authorities in those countries may access the data. Further information can be found at: https://support.google.com/analytics/answer/6004245

Spam Protection

The Agency uses Cloudflare Turnstile, a service provided by Cloudflare Inc., to protect its contact forms from spam and automated abuse. When the service is loaded, technical connection data (in particular your IP address and information about your browser and device) is processed and transmitted to Cloudflare. This processing is used to distinguish between human users and automated requests. The processing is based on Article 6 (1) (f) GDPR (legitimate interest in ensuring the security and proper functioning of our website). Cloudflare is an international company. Data may therefore also be processed outside the European Union, in particular in the United States. Further information can be found at: https://www.cloudflare.com/privacypolicy/

Contact

If you contact the Agency by email or via a contact form, the data you provide will be stored for the purpose of processing your enquiry and for follow-up questions. Processing is carried out for the purpose of taking steps prior to entering into a contract or for the performance of a contract, as well as on the basis of the Agency’s legitimate interest in handling your enquiry.

Data Retention

Personal data is stored only for as long as necessary to fulfil the respective purposes. Data from enquiries is stored for the duration of processing and beyond, where necessary, for follow-up communication. Where statutory retention obligations apply, in particular under commercial or tax law, data will be retained in accordance with the applicable legal requirements. Analytics data is processed in anonymised form.

Your Rights

You have the right to access, rectification, erasure, restriction of processing, and data portability. You also have the right to withdraw any consent at any time with effect for the future, as well as to object to the processing of your data. If you believe that the processing of your personal data infringes data protection law, you have the right to lodge a complaint with a supervisory authority. The competent supervisory authority in Austria is the Austrian Data Protection Authority.

Data Security

The Agency implements appropriate technical and organisational measures to protect your data against loss, misuse, or unauthorised access.

Changes

The Agency reserves the right to amend this Privacy Policy where necessary.
